US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling charges, he was detained in immigration custody.
In her order, the court pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
